What is asbestos exposure?
Asbestos is a type of insulation material that was frequently used in building works across the UK until the late 1990s. When asbestos is disturbed, such as during building works or housing repairs, it can release fine dust particles that are hazardous to inhale.
Long-term exposure to asbestos dust can have harmful effects on the human respiratory system and can cause permanent, and often fatal, damage to the lungs. Exposure has also been proven to cause several long-term illnesses, including the lung cancer mesothelioma.
Although the dangers of asbestos have been known in the UK since the 1930s, many employers failed to warn or provide protection for their workers. However, new use of asbestos was finally banned in this country in 1999.

What is mesothelioma?
Mesothelioma is a type of cancer that usually develops in the lining of the lungs (pleural mesothelioma) but can also affect the lining of the abdomen (peritoneal mesothelioma) and the lining of the heart (pericardial mesothelioma).
The main cause of it is the exposure to asbestos dust which gets into the lungs and develops into one of the forms of mesothelioma.
What are the symptoms of mesothelioma?
The symptoms of mesothelioma can include the following:
- Shortness of breath
- Tiredness
- Chest pain
- Persistent cough
- Sweating and high temperatures
- Weight loss
- Loss of appetite
- Difficulty in swallowing

The condition will require ongoing treatment and there are a number of local support groups in regions around the country that can help. The London Asbestos Support Awareness Group (LASAG) is an independent charity set up to assist patients and families affected by asbestos disease across London and the south east.

How long do I have to bring a claim?
The law normally requires that court proceedings be started within three years of when you are first told that you have an asbestos-related disease, or within three years of the date the person concerned has passed away. Can I still claim if my employer no longer exists?
Yes – a compensation claim can still be brought, as long as the employer's insurer can be traced.
Even if this is not the case, all is not lost. An application can still be made to a government scheme to obtain any compensation owed. We will advise you on your options when we examine the details of your personal case.
I already have a solicitor acting for me. Can I transfer to another?
Yes. You are free to instruct a solicitor of your own choice. Transferring your claim shouldn't present a problem. Any costs that may be due to your current solicitor can usually be put on hold and recovered at the end of the case if it is successful, along with any fees of your new solicitor.
What happens to my claim if I passed away before the case is finished?
The claim can continue in the case of your death. In many asbestos-related claims, the victim has unfortunately already passed away. In these cases, it is often the family that makes a claim against the employer for the loss of a loved one.
